I missed my connection, what are my rights?

If you missed your connecting flight because of problems with your previous flight such as a delay or cancellation, the airline should offer you a new flight under similar circumstances. If travelling doesn't make sense anymore for you, the airline has to fly you back to your departure airport.

Usually airlines will arrange new tickets for affected passengers. If the waiting time at the airport is longer than 3 hours, they are furthermore obliged to provide you with food, drink and two phone calls. If your replacement flight departures the next day, a hotel accomodation for the night has to be provided, too. In cases where airlines do not take care of their aforementioned duties, air passengers should keep the bills and receipts for these expenses incurred to claim them in addition to their compensation.

Legislation

The European Regulation 261/2004 stipulates that passengers are entitled to compensation if the arrival delay is more than 3 hours. If you miss the connecting flight, you will often arrive later than 3 hours in relation to your original travel plan. The amount of compensation is determined based on the distance travelled.

The EU Regulation 261/2004 declares that passengers are entitled to compensation if the arrival delay is more than 3 hours. Often times you will arrive more than 3 hours later compared to their initial flight plan. The compensation amount complies with the distance travelled:

  • €250.00 for flights up to 1,500km
  • €400.00 for flights between 1,500 and 3,500km
  • €600.00 for flights over 3,500km

For long-distance flights of more than 3,500km where the arrival delay at the final destination is between 3 and 4 hours the compensation amounts to €300, for delays of more than 4 hours €600.

To claim compensation, there are two further conditions your claim must meet:

  • The flights must be on one booking. Two different operating airlines are no problem, as long as you have booked the two flights at the same time and not separately from different airlines
  • Your first flight was scheduled with a European airline, or departed from the European Union

It can be a difficult process for individuals to obtain their compensation from the reliable airline. Air carriers see their job done properly as long as they brought you from A to B. Nonetheless if passengers arrive with a delay of at least 3 hours, there is still right to reimbursement.

As Aviclaim is processing countless claims we have much stronger position in dealing with airlines than the average individual. They are also aware of the fact that we do not hesitate to take legal action. For these reasons our clients receive their compensation faster than usual, and they receive more than usual.

Why Aviclaim?

Legal Process

We want passengers to get their reimbursement from airlines. Airlines generally reject claims arguing that the flight was delayed no more than 3 hours. However, you have to check the arrival delay at your final destination, which can be different to your previous delay. If necessary, we will file a lawsuit without additional costs for you.
